Section 01Agreement to terms
By accessing or using Tout ("the Platform"), operated by Tout Inc., a Delaware corporation ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.
Section 02Description of services
Tout is an influencer marketing platform that connects brands with influencers. The Platform provides analytics, campaign management, audience insights, performance benchmarking, and AI-powered recommendations. Users may connect third-party social media accounts including Instagram, TikTok, YouTube, Pinterest, Snapchat, and Reddit via OAuth authentication.
Section 03Eligibility
You must be at least 18 years old to use the Platform. By using Tout, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.
Section 04User accounts
You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate and complete information when creating your account and to update your information to keep it current. You are responsible for all activity that occurs under your account.
Section 05Social media account connections
By connecting your social media accounts to Tout via OAuth, you represent and warrant that: (a) you have the authority to grant Tout access to your account data; (b) such access does not violate any applicable platform terms of service; and (c) you comply with the developer policies of Meta, TikTok, YouTube, Pinterest, Snapchat, and Reddit. Tout accesses social media data solely through official APIs in accordance with each platform's developer policies. You may revoke access to any connected account at any time through your account settings.
Section 06Artificial intelligence and data processing
Tout uses artificial intelligence and machine learning technologies, powered by Anthropic, to analyze platform data and generate insights, recommendations, and content. You acknowledge that AI-generated outputs are provided for informational purposes only and do not constitute professional, legal, or financial advice. Tout may use anonymized, aggregated performance data to improve its recommendation algorithms and benchmarking features. No individual user data is ever shared with other users in identifiable form.
Section 07Brand and influencer obligations
Brands agree to use influencer data and analytics solely for legitimate marketing purposes within the Platform. Influencers agree that performance data collected through connected accounts will be used to provide analytics and recommendations to brands they work with. Neither brands nor influencers may use data obtained through Tout to circumvent platform policies of any connected social media service.
Section 08Payments and billing
Payment processing is handled by Stripe. By making a purchase on the Platform, you agree to Stripe's Terms of Service and Privacy Policy available at stripe.com/legal. All fees are stated in US dollars. Tout reserves the right to change pricing with reasonable notice.
Section 09Intellectual property
All content, features, and functionality of the Platform, including but not limited to text, graphics, logos, and software, are the exclusive property of Tout Inc. and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
Section 10User content
You retain ownership of any content you submit to the Platform. By submitting content, you grant Tout a non-exclusive, worldwide, royalty-free license to use, display, and process your content solely for the purpose of providing the Platform's services.
Section 11Prohibited uses
You agree not to: (a) use the Platform for any unlawful purpose; (b) attempt to gain unauthorized access to any part of the Platform; (c) scrape, harvest, or collect data from the Platform without authorization; (d) use the Platform to violate the terms of service of any connected social media platform; (e) impersonate any person or entity; or (f) interfere with or disrupt the Platform's infrastructure.
Section 12Privacy
Your use of the Platform is also governed by our Privacy Policy, available at tout.app/privacy, which is incorporated into these Terms by reference.

You agree to indemnify and hold harmless Tout Inc. and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.
Section 16Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may terminate your account at any time by contacting us at privacy@tout.app.
Section 17Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
Section 18Changes to terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting a notice on the Platform or sending an email. Continued use of the Platform after changes constitutes acceptance of the new Terms.
